How It Works

At Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™, we aim to make the process of hiring household and domestic staff seamless, transparent, and efficient.

1. Initial Deposit and Fees

An initial R1 000 (one thousand rand) deposit is payable upon returning the Family Profile Form to us.
The balance of our fee becomes payable once a candidate has been selected.
Our placement fee is 15% (fifteen percent) of the candidate’s annual salary, and includes a three-month warranty, the terms and conditions of which are outlined below.

2. Candidate Selection Process

We begin by taking a comprehensive job description and character specification from you. Based on your requirements, we will present you with a shortlist of up to three (3) suitable candidates, including their CVs, references, and qualifications.

Interviews are conducted at our offices, with a facilitator present to guide the process. The facilitator assists with the interview, ensures that duties are clearly defined, and confirms that each candidate is capable, suitable, and willing to perform the required responsibilities.

3. Employment Contract

Once you’ve selected a candidate, we can assist you in preparing the employment contract.
This contract is fully compliant with the Basic Conditions of Employment Act and clearly outlines the duties and obligations of both employer and employee.

All new employees are subject to a probationary period of up to 90 days. Our facilitator will be present when the contract is drawn up to ensure that the employee understands the terms of employment and what is expected of them.

4. Cancellation and Placement Obligations

Should the Client cancel any arranged interviews or employment before the commencement of duties, the Client remains liable for the full placement fee, even if the interview has not yet occurred or the contract has not been signed.
This is because Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™, would have already fulfilled its obligation to the Client by sourcing and presenting suitable candidates.

5. Employment Without Agency Involvement

If a Client employs a candidate introduced by Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™, within one (1) year of the original introduction — whether directly or indirectly, and whether the agency was involved or not — the Client remains liable for the full placement fee.
This also applies if any member of the Client’s family or any third party introduced by the Client employs the candidate.

6. Non-Payment

If the placement fee is not paid within the specified period, Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™, reserves the right to initiate legal action to recover all outstanding amounts, including legal and investigation costs.

7. Offer of Employment

Once a candidate has accepted an offer of employment from the Client, the Client becomes liable for the placement fee, even if the employment contract has not yet been signed by either party.

Warranty

In the event that the employee is deemed unsatisfactory, the Company agrees to provide one replacement employee at no further cost to the Client, provided such request is made within ninety (90) days from the employee’s commencement of employment.

Terms & Conditions

1. Placement Fee

Our fee is calculated as fifteen percent (15%) of the employee’s annual salary. This fee is due and payable on the day the candidate is selected by the Client. The full fee is payable by the employer, and there is no charge to the prospective employee.

Employment of a candidate referred by Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™ will constitute acceptance of these terms and conditions.

Should the Client cancel the interview or the employment offer before the employee commences duties, the Client remains liable for the full placement fee, even if the interview has not taken place or the employment contract has not been signed. Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™ will have fulfilled its obligation by presenting suitable candidate(s) to the Client.


2. Warranty

The warranty is valid only once full payment has been made immediately upon commencement of the employee’s employment.

The warranty will not apply where the employee’s employment ends due to:

  • Operational requirements or retrenchment

  • Unfair labour practices by the Client

  • Breach of contract by the Client


3. Replacement Policy

Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™, will replace the employee with another candidate who is willing and able to fulfil the same duties as stated in the original employment agreement.

While every effort will be made to find a replacement as soon as possible, replacement will be provided within fourteen (14) days of either the employee leaving employment or notification from the Client requesting a replacement.


4. Disclaimer

Although every reasonable effort is made to ensure that all referred candidates are honest, competent, and without a known history of negligence, misconduct, or dishonesty, accidents may occur. Rent a Gardener (Pty) Ltd, incorporating Rent a Domestic™ accepts no liability for any act, omission, or delict by the employee that may result in damage, loss, or injury to the Client or the Client’s property.
